Medical Marijuana Smoking Ban Challenged in Court by Patients, Smoking Medical Marijuana in Florida – Lawsuit Update

When the 2016 amendment was passed to allow Florida residents suffering from a variety of illnesses to medical marijuana, initially that meant every form of the plant. However in 2017 state lawmakers moved in to ban smoking cannabis altogether, making it legal to only vape, have edibles, oils and tinctures. However for some patients who have diseases like ALS, the only way they can consume marijuana in any form is through smoking. Smoking in this case is what keeps the patient’s lungs clear and is the only system that works to relieve pain and anxiety.

The real issue that comes into play in this case in the question of legality. The plaintiffs in this case are asking for the judge to rule in favor of also legalizing cannabis in a smokable form, but the state lawyers who are arguing against the allowance make a case that those who are trying to get the law to change don’t really have a leg to stand on, seeing that they are not legal marijuana consumers who haven’t taken the necessary steps through the system to obtain medical marijuana in any form. In turn John Mills, the attorney fighting for the plaintiffs in this case, counters that because the smokable form of marijuana is the only one they can use is illegal, so they have to go about getting it other ways. The overall issue surrounding this is that the law was passed with 71 percent of Florida residents voting in favor of medical marijuana, which to them meant in all forms like other states have done. The patients who are restricted to forms of cannabis that aren’t beneficial to them feel like they are still in danger of being arrested for their use, even though they are just as in need as any other patient.

The judge in this case is slated to make a decision in a few days, though there hasn’t been a deadline set.

  1. is smoking the only method of medical marijuana ? My pain msgmt dr. just advised of the availability of marijuana he dispense. He was too busy for me to ask questions and my next appt. is in May meantime if use Percocet. what other method is available. Thank you for your attention to this msg. Respectfully John Sanchez

    • Hi John- Thanks for your question. Florida currently allows for a few different ways of administering medical marijuana. Doctors can prescribe/recommend oils, sprays, lotions, and more.- CalmEffect
