Will Medical Cannabis Patients Soon Be Allowed To Grow Their Own Marijuana?

Joe Redner, a well known Tampa businessman, has filed a suit for the right to grow medical marijuana on his own. He’s fighting for this right due to his own battle with cancer and has benefited so much for the effects of medical cannabis, both during and after treatments. His reasoning surrounds the prices of obtaining marijuana in Florida, which requires regular visits to a doctor who can legally prescribe it, getting the card and keeping it current through updates, and of course actually going to a dispensary to purchase cannabis products. All of these expenses can certainly start to add up, so Joe argues that it’s his constitutional right to provide himself with his own medications.

Since at the moment the state Department of Health only allows a handful of dispensaries to actually grow marijuana, and are working to have this lawsuit dismissed entirely. At the moment, Joe is at a bit of an impasse seeing that the judge ruled that the state couldn’t have the case thrown out, but he wasn’t allowed to start growing yet either. There are currently six lawsuits that have been filed looking to allow for individual growing rights. Mike Minardi, an attorney who has been a prominent voice in the fight for patients’ rights, acknowledges that this issue could potentially change the whole medical cannabis industry. If allowance to grow is actually passed then the assumption is that the Department of Health would have to come up with new rules in terms of how many plants each person could grow, and of course, determine new selling and distribution laws.

There hasn’t been a decision made quite yet in this case but it was reported that the health department is reviewing what this ruling would mean and how they would proceed if indeed the ruling moves in favor of Joe Redner and the other suits in these cases.
