Morgan Wins Smoking Lawsuit Against Florida – John Morgan has won his case, leading the way for smokable medical marijuana!

Judge strikes down Legislature’s ban on smoking medical marijuana

A Leon County circuit court judge ruled Friday afternoon that the state’s ban on smoking medical marijuana is unconstitutional, setting up continued legal fights as the state appeals the decision.

In a 22-page order, Judge Karen Gievers said that the Legislature’s ban on smoking medical cannabis conflicted with the intent of a constitutional amendment that had broadly legalized the drug for medical use after voters approved it in 2016.

She concurred with arguments made last Wednesday by Jon Mills, an attorney for the plaintiffs, contending the definition approved by voters included “all types of medical marijuana,” including forms that can be smoked. Mills had also argued that the amendment implicitly recognized smoking in private by recognizing that there was no right to smoke it in public places.

Gievers, in striking down the ban, invoked both George Washington and Thomas Jefferson in her decision and highlighted Washington’s characterization of the constitution as a “sacred obligation.”

The news is still coming out and what the process will be is still to be determined, but big news heading into the weekend is that John Morgan has won his lawsuit and the Judge declared that the prohibition against smoking was invalid. Your physician still has to recommend it for you, but smoking will be added to the list of options.  We will be sure to keep you up to date on what happens next. Hopefully an appeal doesn’t hold this up.

  1. I think having to pay that amount of.money to get a weed is absurd. It’s just away for the government to take more money from the citizens of the U.S.A. That is against our constitutional right. If they would just legalize
    Marijuana for recreational use like Canada did the U.S.A. could tax it and help out the economy. If the government is set on pricing it. It could be bought just like they do with alcohol. I think the crime rate would go way down. Look back when alcohol wasn’t legal, it’s the same way with Marijuana. Marijuana can’t harm you as long as you use it responsibly.You drink alcohol and if you drink too much you get drunk. I personably rather be around people who are as high as a kite then be around a bad drunk. I’m not saying that all drunks are bad, because their are good and bad. That probably goes the same for Marijuana. Everybody is different about anything that a person might do. Well I think I said how I feel. Freedom of speech, right ?

    • Hi Wendy- We don’t have individual Doctor prices. That said, we are seeing that the current average is around $200-249 for an initial appointment and $100/$150 for follow ups.

  2. I agree very much with Gary. Why should we even have to pay for Marijuna ? It’s just a weed and who’s to say how we can use it. It’s not a drug, it’s just a plant it doesn’t cost anything to manufacture it, just some good soil and water and of course some seeds. You probably don’t even have to have a green thumb.

  3. why cant we grow our own[just 3-6 plants ?] ? its given special interest the rights too total market and to control price !! id say that is unconstitutional under equal protection under florida an us constitution !!!

  4. Do I have to pay a dr to get it in the mail? What is the average cost to get a card? How long are they good for?

    • Hi Lisa- We are seeing most initial doctors appointments between $199 and $299 although there are some higher and lower- but you do need to see the Doctor. You have to pay the State $75 with your application. You then have to see the Doctor every 7 months according the law, but some Doctors have different requirements.
