Politico reports that Florida Gov. DeSantis has identified eight nurseries that would get licenses to grow and sell medical marijuana in Florida. Now that smoking is legal and edibles are on the way, this presents more access for Florida medical marijuana patients

Gov. Ron DeSantis has drafted a short list of eight nurseries that would be allowed to grow and sell medical marijuana under a tentative settlement with companies over how the state ranks cannabis license applicants, according to a person close to the talks.

The list of nurseries, which POLITICO obtained from the person close to the settlement negotiations, includes Bill’s Nursery, DeLeon’s Bromeliads, Dewar Nurseries, Hart’s Plant Nursery, Perkins Nursery, Redland Nursery, Spring Oaks Greenhouse and Tree King Tree Farm.

The companies were among of a pool of 28 applicants that had applied for licenses under a 2014 law. The successful applicants included nurseries that eventually became Trulieve and Surterra, which now command the majority of the state’s medical marijuana market.

The Department of Health last issued a license in 2018 to Miami-based Nature’s Way Nursery, which had challenged the agency’s applicant-ranking system in state administrative court. In July 2018, administrative law Judge John Van Laningham called the ranking method a “colossal blunder that turned into a dumpster fire.”

Six of the nurseries on the DeSantis list had moved to join the Nature’s Way case after Van Laningham’s ruling.

DeSantis has criticized state regulatory controls that capped dispensaries and required vertically integrated licenses for cannabis growers and sellers, rules he said have given rise to industry cartels. Tampa-based Florigrown successfully sued the state over the law, a case the state has appealed.

DeSantis has suggested that the state settle its dispute with Florigrown, but CEO Adam Elend said no deal was on the table as of Monday, leaving him to fear that licensing nurseries on the governor’s list would expand the industry cartel instead of eliminating it.

“I know what these people have in common — they applied for a different program in 2014 and not the law we have now,” Elend said. “That would mean this is more of the same, and that would be disappointing.”

Spring Oaks Greenhouse lawyer John Lockwood said a list of potential licensees has been rumored for three months, but no decisions have been made.

“This litigation has been going on for quite some time and I think it would be premature to say if any of the names floating around out there is true,” Lockwood said.

DeSantis’ office did not respond to a request for comment.

A settlement with Florigrown would be the next step toward delivering on a DeSantis campaign promise that he would, by summer, complete implementation of the 2017 law that expanded medical marijuana use. Eleven licenses remain up for grabs, including four that were triggered recently, when the state reached 200,000 patients.

Medical Marijuana Business Association of Florida co-founder Taylor Biehl said the industry has matured since nurseries first applied for licenses under the 2014 law. The caliber of potential applicants also has increased, he said.

“We now have a more mature marketplace, thus better applicants in the pipeline,” Biehl said. “So if these applications are decided in the near future, they should not be counted against the 11 licenses available.”
