Medical Marijuana Qualifying Conditions

Montana - Qualifying Conditions:

The Montana Medical Marijuana Act (MMA) has gone through extensive changes since it became law in 2004. The most recent changes occurred when the 2019 Legislature passed Senate Bill 265 (SB265) creating more detailed program regulations. Some of the provisions in the new law went into effect upon passage, May 3, 2019.  Patients, providers, physicians and labs are encouraged to become familiar with the provisions of the new law.

Debilitating medical condition means:

  • cancer,
  • glaucoma,
  • positive status for human immunodeficiency virus,
  • or acquired immune deficiency syndrome when the condition or disease results in symptoms that seriously and adversely affect the patient's
    health status;
  • cachexia or wasting syndrome;
  • severe chronic pain that is persistent pain of severe intensity that significantly interferes with daily activities as documented by the patient's treating physician;
  • intractable nausea or vomiting;
  • epilepsy or an intractable seizure disorder;
  • multiple sclerosis;
  • Crohn's disease;
  • painful peripheral neuropathy;
  • a central nervous system disorder resulting in chronic, painful spasticity or muscle spasms;
  • admittance into hospice care in accordance with rules adopted by the department; or
  • posttraumatic stress disorder

"Marijuana-infused product" means a product that contains marijuana and is intended for use by a registered cardholder by a means other than smoking.  The term includes but is not limited to edible products, ointments, and tinctures.  MORE INFO HERE

11/16/20 - Montana regulators are taking steps to implement the voter-approved legalization of marijuana.

11/9/20 - Montana marijuana opponents filed a new lawsuit that seeks to overturn the state’s voter-approved legalization initiative.

11/3/20 - Montana voters approved marijuana legalization.

11/2/20 - Montana’s Department of Agriculture launched a state-hosted online Hemp Marketplace where buyers and sellers of the crop—including seeds, fiber and derivatives like CBD—can connect.

10/23/20 - The Montana Supreme Court rejected a lawsuit claiming that a marijuana legalization initiative that’s on the state’s ballot violates the state constitution by appropriating funds. The justices didn't rule on the merits of the claim, but said opponents failed to demonstrate the need for the high court to take it up. A lawyer for the opposition campaign said they will be pursuing the matter in a lower court soon.

10/19/20 - Montana marijuana opponents are trying to block the state's legalization ballot measure because they say it violates the state constitution by appropriating tax revenue to specific programs. Voting is already underway, so it’s unclear what will happen if the challenge succeeds in the state Supreme Court.

10/15/20 - A new poll shows that Montana voters are poised to approve marijuana legalization ballot measures next month—but 10% of voters are undecided, and turnout by young people could make all the difference.

10/6/20 - Montana marijuana activists hosted a press conference about how the state's marijuana legalization ballot initiatives would benefit public lands.

9/30/20 - A coalition of environmental groups—including the Montana Conservation Voters and Montana Wildlife Federation—is endorsing marijuana legalization initiatives on the November ballot. Half of the state’s cannabis tax revenue would be earmarked for conservation efforts under the measures.  Interestingly, the marijuana-derived funds would open up access to more matching federal dollars to support public lands.

Also, Montana marijuana activists commissioned a study that concluded the state will generate $52 million in annual tax revenue by 2026 if legalization ballot measures are approved in November.

9/16/20 - The Montana commissioner of political practices is probing North Fund, which has given more than $2.9 million to a marijuana legalization campaign in the state.

9/15/20 - The Montana Chamber of Commerce is opposing the state's marijuana legalization ballot measures.

9/14/20 - Wrong for Montana is a new group campaigning against the state's marijuana legalization ballot measures.

8/14/20 - Montana’s secretary of state certified that activists collected enough signatures to put two marijuana legalization measures on the November ballot. 

7/20/20 - Montana marijuana activists say official data from county elections officials show they collected enough signatures to qualify two legalization measures for the state’s November ballot. The secretary of state must formally certify the initiatives by August 20. 

6/29/20 - Montana regulators said that medical cannabis cardholders can continue to submit renewal applications without physician statements though July 30.

6/22/20 - Montana marijuana activists submitted what they say are more than enough signatures to qualify legalization measures for the November ballot. 

6/15/20 - Montana marijuana activists say they are "within striking distance" of having enough signatures to qualify legalization measures for the November ballot.

5/28/20 - A Montana law allowing medical cannabis patients to purchase from any dispensary goes into effect on Tuesday. 

5/19/20 - Montana Democratic Senate candidate John Mues tweeted, "A number of people have asked for my position on the legalization of marijuana in Montana.  My position, since Day 1, has been the same:  I'm for it."

5/18/20 - Marijuana activists in Montana and Nebraska officially relaunched signature-gathering efforts with new social distancing protocols for safe petitioning amid the coronavirus pandemic. 

5/14/20 - Montana regulators extended the deadline for hemp cultivation license applications to June 1.

5/13/20 - Montana marijuana activists are hiring paid petitioners for a proposed legalization initiative.  Also, Montana hemp growers voted to establish a 1% checkoff for hemp, with funds earmarked to support research, market development and education.

5/12/20 - Montana regulators sent a bulletin about the upcoming untethering of medical cannabis patients from specific dispensaries.

5/11/20 - Montana's secretary of state is allowing voters to download, sign and mail in ballot petitions, which could boost efforts to qualify a proposed marijuana legalization initiative.

5/7/20 - The Montana legislature's Children, Families, Health and Human Services Interim Committee will discuss a report on medical cannabis and chronic pain during a hearing next week.
