Florida Judge Lifts Caps on Limit of Dispensary Locations
Last Friday, a judge ruled that Florida’s limit on locations for medical marijuana providers adds an unconstitutional restriction and threatens patient health. Trulieve is currently the only medical marijuana provider to hit the limit. They began a lawsuit protesting the cap over a year ago.
Judge Karen Gievers wrote, “The evidence clearly and conclusively establishes beyond any doubt that the imposition of regional and statewide caps on the number of dispensaries for each licensed [medical marijuana treatment center] does not support Voter-Approved constitutional goals.”
The 2017 amendment decriminalizing medical marijuana in Florida included a provision explicitly forbidding lawmakers to enact provisions inconsistent with voter intent.The originally enacted law limited the number of licenses that could be provided to medical marijuana treatment centers, and set a cap of 25 dispensaries per company.
Trulieve plans to expand the number of dispensary locations throughout the state as soon as possible.
