The decision to recommend cannabis therapy is up to the discretion of the treating physician. There are NO qualifying conditions for medical marijuana in Oklahoma, all you need is a certified physician’s recommendation.

Medical Marijuana Conditions for Oklahoma – Physician Requirements

(a) Any Physician, before making a recommendation for medical marijuana under these provisions, shall be in “good standing” with their licensure board. Physicians in residency or other graduate medical training do not meet the definition of Physician under this Subchapter and any recommendation for a patient medical marijuana license will be rejected by the Department.

(b) When recommending a medical marijuana license, a physician shall use the accepted standards a reasonable and prudent physician would follow when recommending any medication to a patient.

(c) A physician shall not be located at the same physical address as a dispensary.

Medical Marijuana Conditions for Oklahoma – The purpose is to ensure the health and safety of all Oklahomans and provide reasonable and orderly regulation of medical marijuana as authorized by the lawful passage of State Question 788, codified as 63 O.S. § 420 et seq.; 63 O.S. § 427; the Oklahoma Medical Marijuana and Patient Protection Act, 63 O.S. § 427.1 et seq.; and the Oklahoma Medical Marijuana Waste Management Act, 63 O.S. § 427 et seq. Guidance for Physicians – New Program Changes

  • Podiatrists- Physicians licensed by and in good standing with the Board of Podiatric Medical Examiners will be authorized to recommend medical marijuana. Please select this board on patients’ Physician Recommendation Form if you are a podiatrist that meets these requirements.
  • Short-term Licenses – A new short-term, 60-day medical marijuana patient license will be available for Oklahoma patients whose physician recommendation is only valid for 60 days. Patients will need to provide a 60-Day Physician Recommendation Form, which will be available on this webpage, and select this license type in their online application.
  • Physician Termination of Patient Licenses – Recommending physicians will be authorized by law to terminate the license of a patient who no longer meets the requirements for the continued use of medical marijuana. Recommending physicians who wish to terminate a patient’s license must complete the Physician Termination of Patient License Form, which will be available on this webpage.

New Regulations for Medical Marijuana Program Approved

The Oklahoma Medical Marijuana Authority has received approval from Governor Kevin Stitt on emergency rules that will update current regulations and establish new license categories in accordance with statutory modifications made during the 2019 legislative session. The authority will make available all new forms and applications on its website beginning August 30. New emergency rules will be effective on September 14.

For patients, the changes include the ability to obtain a medical marijuana recommendation from physicians licensed by and in good standing with the Oklahoma Podiatric Medical Examiners Board. Podiatrists (D.P.M.) will now be able to provide recommendations along with Doctors of Osteopathy (D.O.) and Medical Doctors (M.D.).

A new 60-day short-term license will be available for adult and minor Oklahoma residents with a 60-day doctor’s recommendation. The license fee will be $100 or $20 for patients who qualify for a discount.

Veterans with a 100% disability rating from the Veteran’s Administration will now be able to receive a medical marijuana patient license with a discounted application fee of $20.

The online renewal system for businesses will be available starting August 30 as well. Businesses should submit their renewal application prior to the expiration date of their license but no sooner than 60 days before it expires. Submitting the renewal application on time will allow the existing license to remain valid while the renewal is in process.

Stand-alone transporter licenses are a new business license category, along with individual transporter agent licenses. A transporter license and an individual transporter agent card will be required for transporting medical marijuana. The fee for stand-alone transporter licenses is $2500 for one year, and the fee for each one-year transporter agent license is $100. Growers, processors, and dispensaries will continue to be issued a transporter license upon approval of their business license. Transporter agents must work with their employers to submit their application and must apply for a separate license for each employer if working for multiple businesses.

All business applicants are now required to submit with their application a Certificate of Compliance completed by the political subdivision where the business is located. The required certificate is available at OMMA.ok.gov. Businesses within the City of Oklahoma City’s jurisdiction will submit the certificate provided by Oklahoma City.
