New York May Ban Drug Testing Potential Employees for Cannabis

In hopes of getting ahead of the issue, New York City Council’s Progressive Caucus is introducing a bill to bar employers from testing job applicants for cannabis. Many states that have legalized cannabis are currently dealing with the issue of a policy for drug testing employees in the workplace. THC, the main psychoactive ingredient in cannabis, can linger in the body for weeks after its effect has worn off. This means that employees can test positively for cannabis use that occurred off the clock.

The council has put forward a bill that would ban the practice of testing potential employees for THC. The practice of drug testing employees after their employment date would not be affected by this bill. “It doesn’t make sense that this would be something that would prevent someone from getting gainful employment,” said Councilman Jumaane Williams. “  If you ingest weed in whatever manner a month ago, I’m not sure how that prevents you from doing your job now,” Williams told the NY Daily News.

Move to Ban Drug Testing Potential Employers Part of Larger Push to End Tests for THC

Councilman Williams isn’t the only member of City Council’s Progressive Caucus to introduce bills to eliminate tests for THC. Councilman Donovan Richards, who also heads the Council’s Public Safety Committee, sees an end to cannabis tests as a way to help reduce the city’s prison population. To that end, Richards will soon propose a bill to stop testing people on probation for THC. “While we’re working to decrease the population in Rikers, we should be finding reasons to keep people out of the system, not more hurdles to trip them up and send them back,” Richards said. Richards’ proposal already has the backing of several ex-probation officers and a former district court judge.

A third bill takes aim at a little-known consequence of testing for THC: interventions by child protective services. When a person uses a public hospital in the city, they are very frequently screened for illicit substances. And if a parent tests positive for THC, public hospitals alert the Administration for Children’s Services (ACS). From there, ACS can pass the information on to the NYPD and conduct their own investigations. These investigations can lead to parents losing custody of their children, just for testing positive for THC.

In addition to this employment testing bill, the council is also introducing a bill that would stop testing people on probation for THC.

  1. I agree with this. I can’t leave the state with ANY of my medical marijuana. I can’t smoke it so I use capsules and the oral thick gel syringes. THIS IS MEDICINE FOR ME!!!I quit Dilaudid over a year ago. I have extreme chronic pain from a lot of surgeries. So, in order to leave I have to get an RX for pain medication just to get by. I’d much prefer Not doing this. PLEASE make it legal in the US for people that use this for medication. And Brock. Try sativa for daytime use. It’s not doping, my mind feels alert and happy with certain varieties of this strain. I wouldn’t walk around in my nighttime, Hell I couldn’t. It’s for SLEEP and extreme pain. So please make it legal to at least have enough product for a trip to another state! It’s medicine!!!!

Well 5 years ago I moved to Florida from Upstate New York I enjoy the benefits of cannabis and the effects it has on my situation … BUT I don’t really see anything happening it isn’t really any different now than it was when I moved here.. legally your a criminal still but if a Dr prescribed me some pills I’m legal to be a walking zombie but if I smoke a joint and I’m able to feel fine and go out in public and act accordingly. Socially it is not excepted..As a United States of America citizen if it’s good in one state make it good for them all… The government in state and federal levels has been doing nothing for it’s CITIZENS for way to long
