Acceptance of Medical Marijuana

Medical marijuana, or medical cannabis, has been highly debated in the United States over the past few years. Those that suffer from terminal illnesses, or have long-term symptoms associated with a medical issue, sometimes request medical marijuana as an alternative to pharmaceuticals for treatment and pain relief.

Generally, medical marijuana is no different than standard marijuana. It is classified as a Schedule 1 Drug, which means it has the potential for abuse, is not currently federally accepted as medical treatment in the US, and doesn’t have an acceptable amount of safe use under medical supervision. Because of this, there is a growing debate when it comes to the personal use of marijuana and the legality of it. Some law officials and those that hold political offices would like to continue combating the illegal use of marijuana and control some of the effects it has. They don’t condone it for use medically and still find it potentially harmful to those that use it. On the other hand, health advocates are fighting for its legality nationwide, as they believe that it is valuable when it comes to pain relief and the treatment of some debilitating diseases.

Acceptance of Medical Marijuana

Medical marijuana is legal in some areas as acceptance of Medical Marijuana grows, but not in all geographic locations in the United States. Federal and state laws consider it a crime to grow, sell, use, and possess marijuana. Federally, it is illegal to use even for medical purposes. An increasing amount of states are becoming more lenient with it and allowing the use and cultivation of the drug for medical purposes. This removes criminal penalties from doctors who prescribe it to patients that use it within the lines where it is legal. Back in 1996, California became the first state to legalize it, with the passing of the Compassionate Use Act. Since then, 28 states have hopped on board to legalize it for medical purposes!

The states that have legalized it have set some regulations for medical marijuana, including the boundaries for the plant to be recommended, grown, possessed, and used. They vary in regulations, but most require a written letter from a doctor stating that the person is suffering from an ailment that would benefit from the use of medical marijuana. Medical marijuana ID cards are typically given to those that need to use it. The type of condition may affect the amount of marijuana that a person can legally possess. States also have regulations as t if and when one can use medical marijuana at work.

There are still penalties for those with medical marijuana cards if the terms are violated. It could include fines, prison time, or both, depending on the severity of the offense and where it took place. If the state the infraction took place in does not condone medical marijuana, charges are still treated as a misdemeanor or felony drug charges. If the infraction happens in a state where medical marijuana is accepted, offenses are often treated as civil infractions instead. Typical scenarios include possession over a certain amount, the sale of the drug to others, the cultivation of the drug if not allowed, and possession of marijuana paraphernalia.

If you believe that your condition could be treated with the use of medical marijuana, or that the pain you feel on a regular basis could be reduced by using it, you should speak to a professional. They will be able to look at your specific case and medical state to determine if medical marijuana is the right choice for you. Many people benefit by using it for its intended purpose, and you could be on your way to feeling much better in days!

  1. I was approved as a candidate to receive medical marijuana on 12.11 by a medical doctor. All documents were filed and I haven’t heard anything. Was wondering when i might get license number.

    • Hi Cynthia- Our patients from that time period have started receiving their approvals. You may want to check with your doctor or the State medical marijuana office.
